ACT reserves the right to cancel, reschedule, or convert in-person events to webinars or other digital experiences due to circumstances which would make the event non-viable, at ACT’s sole discretion. Should an event be postponed or converted to a webinar/digital experience, ACT will transfer the registration to the new event/date. ACT is not responsible for any expenses which a participant may have incurred related to the cancellation, postponement, or conversion of an event to a webinar/digital experience. 

Registration Qualifications  

By registering for this conference, you confirm that you are over 18 years of age and warrant to ACT that the information you provide when registering is truthful, accurate, complete and not misleading.  ACT reserves the right to deny access or remove from the conference any individual at any time for any nondiscriminatory reason in ACT’s sole discretion. 

 
Liability Waiver 

I UNDERSTAND AND AGREE ACT EDUCATION CORP. ("ACT") WILL NOT BE LIABLE TO EVENT ATTENDEES FOR SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL LOSSES OR DAMAGES OF ANY KIND OR NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO INJURY OR ILLNESS, LOST PROFITS, LOST RECORDS OR DATA, LOST SAVINGS, LOSS OF USE OF FACILITY OR EQUIPMENT, LOSS BY REASON OF FACILITY SHUT-DOWN OR NON-OPERATIONS OR INCREASED EXPENSE OF OPERATIONS, OR OTHER COSTS, CHARGES, PENALTIES, OR LIQUIDATED DAMAGES, REGARDLESS OF WHETHER ARISING FROM BREACH OF CONTRACT, WARRANTY, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE OR IF SUCH LOSS COULD HAVE BEEN REASONABLY FORESEEN. ACT’S LIABILITY FOR DAMAGES UNDER THIS AGREEMENT, REGARDLESS OF THE FORM OF ACTION, WILL NOT EXCEED THE TOTAL AMOUNT OF THE EVENT REGISTRATION FEES PAID BY ATTENDEE. 
 

Disclaimer of Warranties  

ACT gives no warranties in respect of any aspect of the event or any materials related thereto or offered at the event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness, and merchantability. The event is provided on an “as-is” basis.   
  

Intellectual Property  

All intellectual property rights in and to the event, the event content, and all materials distributed at or in connection with the event are owned or licensed by ACT, or the event speakers presenting at the event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the event, in any event content or in any materials distributed at or in connection with the event for any reason except as expressly permitted by ACT.  For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by ACT or any of its affiliates; nor does this Agreement grant to you any right or license to any other intellectual property rights of ACT or its affiliates, all of which shall at all times remain the exclusive property of ACT and its affiliates.  


Privacy  

Please review ACT's Privacy Notice to understand how ACT collects, uses, maintains, shares, and protects your information when you visit ACT websites that provide a link to this Privacy Notice (collectively, the "Site"), as well as when you provide your personally identifying information to us online and offline when you participate in ACT’s assessments, programs, and services.  

ACT may make recordings of the event for use in future educational, commercial, marketing, or other purposes. By registering for this ACT event, you understand and agree, and grant permission to ACT Education Corp. and its affiliates, subsidiaries, or vendors (“ACT”) to record you and, if applicable, any presentation and presentation content you may present, whether in audio, video, photographic, or other form, (collectively “Recording”) during the event at ACT’s option and in ACT’s sole discretion. You understand and agree ACT may use such Recording for ACT internal display and demonstration, as part of its marketing or promotion program or for other purposes in ACT’s discretion, in electronic or print form, in all media now known or in the future created without compensation. You warrant that you have the authority to grant these rights to ACT and agree to indemnify and hold harmless ACT from any claims, liabilities, damages, and expenses arising from a breach of this warranty.  

Gift Law 

ACT Education Corp. is committed to the highest standards of ethical conduct. Any complimentary food or drinks offered at an ACT-hosted event are not intended as a gift to any particular public official or employee. Please do not participate in the refreshments if applicable laws, rules or policies do not allow you to do so. In the event ACT provides parking, ACT will accept payment for the parking if you are required to do so under your applicable laws, rules or policies.
